GENERAL TERMS OF SERVICE

ARTICLE 1 – Scope of application


These General Conditions apply, without restriction or reservation, to any purchase of hotel room reservation services and ancillary services (‘the Services’) offered by Domaine Ribiera to customers. The main characteristics of the Services are presented on the Domaine Ribiera website. The Customer is required to read it before making any reservation. The choice and purchase of a Service is the sole responsibility of the Customer.


The Client declares:

● Have full legal capacity to commit to these General Conditions.

● Make reservations for services and additional services for personal needs


These conditions apply to the exclusion of all other conditions, and in particular those applicable to other marketing channels for the Services.


The Client is informed that Le Domaine Ribiera enters into partnership agreements with third-party travel providers in order to allow him, by using the services offered by these partners on their website, to search, select and reserve rooms at the Ribiera Estate. Any reservation of hotel rooms made under these conditions implies consultation and complete and unreserved acceptance by the Customer of the special conditions of the service provider, the conditions of sale of the reserved rate and these general conditions of sale. The Client declares having obtained from Domaine Ribiera all the necessary information available on the website.

These General Conditions of Sale are accessible at any time on the Domaine Ribiera website and will prevail, where applicable, over any other version or any other contradictory document. Unless proven otherwise, the data recorded in the Domaine Ribiera computer system constitutes proof of all transactions concluded with the Client. Thus, the entry of banking information, the acceptance of the General Conditions of Sale, the Conditions of Sale of the price or the Reservation Request, has the same value between Le Domaine Ribiera and the Customer as a handwritten signature on paper. The computerized records kept in the IT systems of Domaine Ribiera will be kept under reasonable security conditions and considered as proof of communication, order and payment between Domaine Ribiera and the Client.


The Customer is informed that his IP address is recorded at the time of booking. In accordance with the Data Protection Act of January 6, 1978, the Customer has, at any time, a right of access, rectification, and opposition to all of his personal data by writing to Domaine Ribiera.

Validation of the reservation of Services by the Customer constitutes acceptance without restriction or reservation of these General Conditions.

The Client acknowledges having the required capacity to contract and acquire the Services offered on the Domaine Ribiera website.

These General Conditions of Sale may be subject to subsequent modifications, the version applicable to the Customer's purchase is that in force on the website on the date of the reservation.

These General Conditions of Sale are applicable for the duration of the online availability of the services offered by Le Domaine Ribiera on the Domaine Ribiera website.




2. RÉSERVATIONS


The Customer chooses any Service presented on the Site by following the route provided for this purpose.


Reservations for Domaine Ribiera Services are made by the Client on the Site.

The reservation process varies depending on the navigation and the Customer's request; it includes the following steps for booking stays with one or more Additional Service(s):


- Step 1: providing search criteria, such as the date of the stay


- Step 2: the results and, where applicable, one or more Complementary Service(s)


- Step 3: details and characteristics of the selected Service(s), particularly if it is an Accommodation Service: the characteristics of the Accommodation (standing, size of the room, TV, minibar, etc.), the length of stay, the options offered (example: breakfast, etc.), the total price of the reservation including details of applicable taxes, the legal information form in the presence of a related travel service or tourist package, and all applicable Special Conditions (guarantee policies, cancellation conditions, check-in time, etc.);


- Step 4: summary of the reservation of the Service(s) with: reminder of the main characteristics (duration of stay, characteristics of the Accommodation Service and/or Additional Service(s), amount including tax with details of applicable taxes) and, information by the Customer of their contact details.


- Step 5: finalizing the reservation of the Service(s) by the Customer with: providing the details of their means of payment, i.e. in the case of prepayment of the reservation, in total, before the stay, and acceptance General Conditions and Special Conditions relating to the reservation before its validation by the Customer


- Step 6: taking into account the reservation of the Service(s) by Le Domaine Ribiera


- Step 7: an email confirming the reservation of the Service(s) is sent to the Customer summarizing the Service(s) reserved, the price(s), the Special Conditions accepted by the Customer, the date of the reservation made.


For the various other services (golf, SPA, tourist service) a subsequent validation will be sent to the customer.


3. PRICE AND PAYMENT


The prices relating to the reservation of the Services are indicated before, during and after the reservation.


For Accommodation Services, the prices indicated are per room for the number of people and the date selected.


When confirming the reservation of a Service, the total price is indicated to the Customer in the amount including tax in Euros.


If the total price of the Service reservation is debited at the Establishment in a currency other than that confirmed on the reservation, the exchange costs are the responsibility of the Customer.

Please note that if a conversion of the currency confirmed on the reservation into another currency appears on the Site, it is given for purely indicative and non-contractual purposes, taking into account in particular the possible evolution of exchange rates between the date of reservation and the dates of stay at the Establishment. Based on the total price in euros, this is converted in accordance with the exchange rate of the day.


The tourist tax, presented during the Service reservation process, must be paid directly on site.


Finally, certain promotional offers are only available on the Site and are sold exclusively on the internet and in no case upon receipt of the domain.



PAYMENT

The Customer communicates his payment data either to prepay the reservation before the stay, or as a guarantee of the reservation, by indicating directly, in the area provided for this purpose (entry secured by SSL encryption)


An invoice will be sent in electronic format to the email address provided by the Customer when booking; If the Customer wishes to receive an invoice in paper format, he must expressly request this upon receipt.



Bank guarantee - Pre-authorization

On the day of the Client's arrival, a bank guarantee by pre-authorization will be requested from the Client.

This consists of blocking an amount, with the aim of covering any consumption or expenses of the Customer on site which has not been paid (restaurant, bar, etc.). This fixed amount is determined based on the number of people and the number of nights reserved.

Based on €200 per night

Example: 2 nights = authorization request of €400


The pre-authorization request is not an immediate debit but corresponds to a reserve for subsequent payment, authorized by the Customer's bank, which temporarily reduces the limit of the bank card used to guarantee the possibility of subsequent debit. In certain cases, depending on the Customer's bank, the pre-authorization request may however appear as a pending debit on the bank account associated with the card used.


Any consumption or expenses of the Customer consumed on site will be paid by the Customer on the day of departure.


The pre-authorization will then be released. It should be noted that it usually takes forty-eight (48) hours for the release of the pre-authorized amount to be taken into account, but the delay can reach seven (7) working days or more, depending on the holder's bank.


Customer no-show

If the Customer does not show up on the first day of their reservation, the Customer's reservation will be canceled in full and the Establishment will put the reserved Services back for sale.

Domaine Ribiera will retain, as a deposit within the meaning of articles 1590 of the Civil Code and L 214-1 of the Consumer Code in their current versions, all of the sums paid by the Customer when making their reservation. The Customer will not be entitled to any reimbursement or any compensation.


4. CANCELLATION OR MODIFICATION OF THE RESERVATION OF A SERVICE


The Customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation and/or care services which must be provided on a specific date or period.


Reservations may be subject to modification following the customer's request, with the express agreement of Domaine Ribiera and under the financial conditions of the new period.


If the customer has subscribed to the free cancellation offer 15 days before arrival. The customer must make the cancellation and refund request by email before the 15th day. Only confirmation of receipt and consideration made by the Domaine will be binding.

Deposits (amounts paid in advance) will not be refunded, except as part of the free cancellation offer 15 days before arrival and in compliance with these conditions.


In the event of interruption of a Service due to the Customer, the entire agreed price will be collected.


The Customer must leave his room before 12:00 p.m. on the day the reservation ends. Otherwise, he will be billed for an additional night.


5. CUSTOMER COMMITMENTS AND RESPONSIBILITY


The Client is solely responsible for his choice of Services on the Site and their suitability to his needs, such that Domaine Ribiera cannot be held responsible in this regard.


The Customer is also solely responsible for the information communicated at the time of booking a Service. Domaine Ribiera cannot be held responsible in the event of erroneous or fraudulent information communicated by the Client.


- Any reservation or payment which is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Client will result in the cancellation of the reservation of the Service at the Client's expense, without prejudice to any action Domaine Ribiera may take against this last.


- The Client must not invite into the Establishment a person whose behavior is likely to harm the Establishment


- The Customer must not bring drinks or food from outside sources into the Establishment (rooms and common areas), unless the Establishment has clearly authorized it in advance


- The Client must not smoke in any area (Rooms, common rooms, etc.), except in areas reserved for this purpose.


- The Client must not disrupt the operation of the Establishment and must not compromise the security of the Establishment or the people there


- More broadly, any behavior contrary to good morals and public order within the Establishment as well as non-compliance with the Internal Regulations of the Establishment, will lead to the director of the Establishment and/or any other service provider Service to ask the Customer to leave the premises without any compensation and/or without any reimbursement if payment has already been made. In the event that no payment has yet been made, the Customer must pay the price of the Services consumed before leaving the premises.


- Minors can only stay in an Establishment accompanied by an adult and provided with personal identification. If the accompanying person is an adult other than the parents, he or she must have parental authorization from the child's parents. The Establishment may request these elements


- The Client also undertakes to ensure that the computer resources made available to it by the Establishment (in particular the WiFi network) are not used in any way for the purposes of reproduction, representation, provision or communication to the public works or objects protected by copyright or related rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required. The Client is also required to comply with the security policy of the Establishment's internet access provider, including the rules for using the security means implemented with the aim of preventing the illicit use of resources. information technology and to refrain from any act detrimental to the effectiveness of these means.


The Customer is responsible for all damage caused by him and/or his guests within the Establishment and bears all costs caused by this damage and/or by non-compliance with the aforementioned rules. Domaine Ribiera reserves the right to intervene if necessary and take any appropriate action against the Client.



6. COMMITMENTS AND RESPONSIBILITY OF DOMAINE RIBIERA


Domaine Ribiera undertakes, within the framework of an obligation of means, to provide access to the Site and the Services offered in compliance with the General Conditions and to act with diligence and competence and to make every effort, within a reasonable limit, in order to remedy any malfunction brought to its attention.


Domaine Ribiera may, however, find itself obliged to temporarily suspend the Site without notice, in particular for technical maintenance reasons, without this giving rise to its liability.


The Client acknowledges and accepts that Domaine Ribiera cannot be held liable for any inconveniences or damages linked to the use of the Internet network, including, without this list being exhaustive:


- the improper transmission and/or reception of any data and/or information on the Internet;


- the failure of any reception equipment or communication lines;


- any malfunction of the Internet network preventing the proper functioning of the Site and/or the reservation of Services.


The Site may refer to hypertext links of other websites published and managed by third parties for which Le Domaine Ribiera disclaims all responsibility for the content of these websites and the services offered there. In this regard, it is specified that the partners are responsible for promoting the offers published on their own websites. The decision to consult third-party websites is therefore the full responsibility of the Customer.


7. FORCE MAJEURE AND DISLOCATION


Neither party may be held liable towards the other party in the event of non-performance of its obligations resulting from a case of force majeure. It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the burden of the resulting costs. Cases usually recognized by the case law of the Court of Cassation are considered to be force majeure. If the force majeure event lasts more than thirty (30) days from its occurrence, these General Conditions may be terminated by any of the parties without any of them being able to claim the award of damages.


In the event of force majeure, an exceptional event or the impossibility of carrying out the Service and in particular of making the room of the Establishment reserved available to the Client, the Establishment may reserve the possibility of hosting, totally or partially, the Customer in a 4 or 5 star category Establishment or carry out a Service of the same nature.


8. CONTACT, CUSTOMER SERVICE AND COMPLAINTS


- To make a reservation, the Customer can contact the domain from Monday to Sunday, from 9:00 a.m. to 10:00 p.m. (Paris time), on +33 4 65 100 900.


- For all questions related to the proper execution of a Service reserved on the Site (requests for additional information, modification or cancellation of a reservation), the Customer is invited to send an email to reservation@ribiera.fr


To facilitate the processing of complaints, it is advisable to send complaints in writing within eight (8) days after the date of completion of the Service.


In his relations with Domaine Ribiera, the Client undertakes to remain courteous and not to make derogatory remarks in particular towards Domaine Ribiera or its employees or collaborators, in compliance with the rules of common sense and courtesy. Domaine Ribiera reserves the right to take any appropriate measure against the Client in the event of harmful or reprehensible behavior (in particular unfortunate, malicious or insulting) with regard in particular to Domaine Ribiera or its employees or collaborators.

The mediator can be contacted within 12 months of sending your complaint.


9. Vouchers and gift boxes
